SIOUX FALLS, S.D. (AP) - The lawyer for the clerk of courts in Hyde County says a federal lawsuit over the release of juvenile criminal records should be dismissed.
Joseph Van Zee of Highmore filed the lawsuit seeking more than $200,000 against Marilyn Hanson, saying she violated his right to privacy and civil rights by releasing his juvenile criminal record, which denied him the chance to serve in the U.S. Army.
In an answer to the lawsuit, an attorney for the Unified Judicial System wrote that Van Zee fails to state a claim on which relief can be granted, the court lacks proper jurisdiction and Hanson has immunity.
Hanson acknowledged that a recruiter contacted her but believes it was earlier, and she denies disclosing the records in the manner alleged by Van Zee.
