IOWA CITY, Iowa (AP) - A bar has filed a lawsuit against Iowa City for being denied a liquor license.
Iowa City's City Council voted 6-0 late Tuesday against granting a liquor license to the Summit Restaurant and Bar.
Council members based their decision on a new policy denying a license to any establishment with underage patrons ticketed for possessing alcohol at a rate of greater than 1.0 per police visit. The Summit, a 19 & older bar, has a ticketing rate of about 1.9 per visit.
Attorney Steven Havercamp says the Summit would appeal the city's decision to the Iowa Alcoholic Beverages Division. Also, in a lawsuit filed Tuesday in Johnson County District Court, Havercamp claims the city's policy violates both the U.S. and Iowa constitutions and exceeds the city's authority.
The lawsuit seeks an injunction to prevent the city from enforcing its policy.
