
SIOUX CITY, Iowa (KTIV) - A judge has thrown out some of the statements made by the man behind the wheel during a fatal, summer boating accident.
Police say Samuel Gomez had a blood alcohol level of point one-six-eight when he stopped suddenly throwing two others on board the boat into the Missouri River, near Dakota City, Nebraska. One of them drowned.
A judge has suppressed statements Gomez made about the 6-to-8 drinks he had that day. He also suppressed information about the time Gomez had the drinks, between Noon and 6:00 pm, at a local bar. The judge said those statements-- made to a conservation officer-- came before Gomez was read his Miranda rights.
However, the judge will allow other evidence at Gomez' trial... including the results of blood tests and urine samples.
