Witnesses in Orellana murder trial say police have wrong suspect


Dakota City, NE (KTIV) - The state has rested and the defense called its first witnesses in the murder trial Andrew Orellana. He's accused of the 1997 murder of Joaquin Guerrero.

The first witness, Orellana's sister, testified that her brother told her on the night of the murder that a man named Bobby Sears shot Guerrero. Authorities have said that Guerrero's murder was gang related.

While South Sioux City police testified Tuesday that there were no leads on the whereabouts of Andrew Orellana for the 12 years since the shooting, Orellana's sister told jurors that no police officers ever came to the residence where her and her brother had been living in Sioux City.

Orellana's sister also said that she had heard Andrew was 'wanted for questioning' in the murder, but she testified she never suggested Orellana go talk to police with the information he had from that night. "If they wanted him for questioning, they would have come to my house," she said.

Orellana's brother-in-law also took the stand. He was living with Orellana in 1997 and says he was a member of the rival gang Guerrero was associated with.

He testified that after the murder, his fellow gang members were looking for Bobby Sears, not Orellana, for possible retaliation.
