Teenage suspect won't return to school after hazing incident

SIOUX CITY, Iowa (KTIV) -

A Sioux City teen, accused in an alleged hazing incident at North High School, won't return to that school.

18-year-old Peter Stewart and three other teens are charged in the assault of a 15-year-old in the wrestling locker room. According to court documents, a few days before the incident, members of the wrestling team actually talked about doing this. The reason? Court documents say the victim didn't "make weight." 

The documents go on to say on the day of the alleged incident 20 to 30 wrestlers were in the wrestling room at the school... and many of them took part in holding the victim down on a table. At the time, documents show there wasn't an adult in the room. But, documents say assistant coach Max Davis came into the wrestling room shortly after... and then told head coach John Torno, and another assistant coach, about the incident. After talking to the wrestlers, Torno decided this was not just a prank, and reported it to the principal and athletic director a few of days later.

Stewart, who is charged with assault was originally suspended for five days, and was ineligible for 3 wrestling matches. But, after an intermediate hearing, Stewart was told he couldn't return to the wrestling team, or to school for the rest of the year. Court documents say he'll finish his senior year in an alternative school. If he finishes classes there, he'll get to graduate, but can't take part in the graduation ceremony.

Stewart's family appealed the decision to the court, and asked for a temporary injunction to set aside the school's ruling. A judge sided with the school in a ruling issued last Friday.

There's no word on what punishments were handed down to 18-year-old Nathaniel Calvillo, or two other minors also charged in the case.
