SIOUX FALLS, S.D. (AP) -
A judge has set an execution date for convicted killer Donald Moeller.
Presiding Judge Kathleen Caldwell set Moeller's execution for some time between Oct. 28 and Nov. 3. The exact time will be up to the prison officials.
Moeller was convicted in the 1990 rape and killing of 9-year-old Becky O'Connell of Sioux Falls.
The U.S. Supreme Court last month refused to hear an appeal of Moeller's conviction, but his 2004 federal lawsuit arguing the state did not follow procedures in setting its execution method is pending.
Mark Marshall, Moeller's attorney, says his client "accepts the execution as the consequences of his actions."
