WAYNE, Neb. (KTIV) -

Two former members of the Wayne, Nebraska police department have unsuccessfully appealed their terminations.

Chief Lance Webster and Lieutenant Phil Shear were fired early in 2011.  City Administrator Lowell Johnson accused the two of misconduct.

Webster was blamed for creating a hostile work environment while Shear was accused of engaging in an extramarital affair with an employee he supervised.

According to the Norfolk Daily News, a district judge upheld Johnson's actions, saying they were "made in good faith."

Last year, the pair appealed their terminations to the civil service commission, which upheld Johnson's decision, as well.
