The breach of contract suit between Penn National Gaming and Missouri River Historical Development has wrapped up in Polk County, IA.
DES MOINES, Iowa (KTIV) -
A big legal argument that could affect the future of a land-based casino in Sioux City wrapped up late Wednesday afternoon.
It's now up to a Polk County judge to decide who'll win a breach of contract lawsuit between Penn National Gaming and Missouri River Historical Development.
Penn National, through their subsidiary The Belle of Sioux City, operates the Argosy Casino.
They want a temporary injunction to keep, nonprofit MRHD, from partnering with another operator and moving forward with a gaming license application that could bring a Hard Rock Casino to Sioux City.
Penn attorneys claim MRHD is in breach of a contract both signed in June.
They claim the nonprofit is violating an exclusivity language in the agreement.
MRHD has countered, saying the contract Penn is citing wasn't approved by the Iowa Racing and Gaming Commission and therefore is not valid.
Judge Robert Hanson said he'll try to render a decision by the early part of next week.
