WAYNE COUNTY, Neb. (KTIV) -
A judge has stopped a move to recall a Wayne County, Nebraska commissioner.
According Kelvin Wurdeman's attorney, the judge said the petition paperwork, which was used to gather the signatures, was flawed because it failed to state whether paid circulators were used.
The recall election was scheduled for November 20th.
The petition was started after Wurdeman was accused of removing dirt from a landowner's field without permission, and using it to fix a road issue.
Wurdeman says he paid the landowner $150 for the dirt.
In a separate case, he was fined $1,000 after pleading no contest to charges he stole a truckload of publicly owned scrap metal.
