A man accused of shooting and killing a Sioux City woman will get a new lawyer. William Gallup's decision to withdraw from the case of 33-year-old Fernando Jaimes-Martinez comes less than a month before Martinez is due for his plea and sentencing hearing.
Martinez is charged with first degree murder, willful injury, intimidation with a dangerous firearm, and being a felon in possession of a dangerous weapon. Court documents say there were irreconcilable differences between Martinez and Gallup. Gallup says the decision was an easy one for both sides. "We had different views as to how the case should be handled," said J. William Gallup, attorney-at-law. "I'm the lawyer, I'm going to control the case, not the client, and so I told him that he should get another lawyer who will either do it his way or maybe he'll change his mind after he listens to another lawyer."
Police say 27-year old Karla Gonzalez died in late September after being hit in the head by a bullet. They say Martinez randomly fired the gun into a crowd of people after a disturbance at 1602 Villa Avenue in Sioux City. Martinez's plea hearing is still set for February 11th.
