LINCOLN, Neb. (KTIV) -
Nebraska's Supreme Court has reversed a lower court's decision in a 2008 accident in Madison County, Nebraska.
At the time, the Madison County District Court ruled the county was partially liable for an accident on a vacant county road northwest of Battle Creek where Larry Blaser and Terry McCaw were hurt. Blaser, McCaw, and McCaw's wife sued the county, saying the county was negligent in failing to maintain a "road closed" warning sign.
The judge ruled the County was partially negligent, and awarded almost 400-thousand dollars in damages.
However, Friday's ruling by the state Supreme Court reverses that decision.
The case will go back to the county for a new trial.
