Norfolk, NE man loses appeal to Supreme Court over kidnapping case

LINCOLN, Neb. (KTIV) -

The Nebraska Supreme Court has denied an appeal from a Norfolk man convicted of kidnapping a nine year old girl.

David Phelps was convicted on charges of kidnapping with intent to sexually molest in the disappearance of Jill Cutshall.

The Norfolk girl disappeared from the front steps of her babysitter's home in 1987.

Her body has never been found, but her clothes were found later at a wildlife area near Norfolk.

Phelps was brought to trial after Jill's mother gathered enough signatures to force a grand jury probe.

Phelps appealed to the Supreme Court, claiming that authorities have a diary with graphic details of four victims being abducted, raped and murdered... one of those victims is Cutshall.

But the high court has denied Phelps' appeal.
