Branstad suspends hours of service rules for propane truck drivers

Governor Terry Branstad has signed a proclamation suspending the hours of service rules for propane truck drivers in Iowa until November 8.

In the proclamation signed on Thursday, Branstad cites low supplies of propane due to the late harvest and high demand for petroleum products throughout the midwest as reasons for the rules suspension.

Branstad says the suspension of the rules is needed to maintain adequate supplies of propane to continue normal harvesting and provide residential heating.

The proclamation suspends the "regulatory provisions pertaining to hours of service for drivers of commercial motor vehicles transporting propane." It went into effect at 12:01 a.m. on Friday and continues until 11:59 p.m. on Thursday, November 7.

Under this state of disaster proclamation, carriers are still required to give a driver at least ten consecutive hours off duty if they inform the carrier they need immediate rest. Carriers cannot require or allow sick or fatigued drivers to operate a vehicle.

Also, if a driver has been on duty for more than 70 hours during eight consecutive days, a carrier must give a driver 34 consecutive hours off if requested by the driver.

Carriers that have an out-of-service order in effect are not allowed to take advantage of the relief from regulations this declaration provides.
