Former Wayne, NE police lieutenant loses appeal with state court


OMAHA, Neb. (KTIV) - The Nebraska Court of Appeals upholds the firing of a former Wayne police lieutenant.

Phil Shear, along with former Wayne police chief Lance Webster, appealed after a district judge rejected their challenges to the city's civil service commission's upholding of their April 2011 firings.

Shear was accused of making sexual advances toward women, and tolerating racial prejudice among officers.

Webster was accused of trying to cover up for Shear.

The state Court of Appeals rejected Shear's argument that he was denied due process.

In late November, the same court rejected Webster's appeal.
