Argosy owner files motion to stop the city of Sioux City from entering the IRGC suit

DES MOINES, Iowa (KTIV) - Penn National Gaming has filed a motion resisting the involvement of the city of Sioux City in Penn's suit against the Iowa Racing and Gaming Commission.

Last week, the city filed an "emergency request" so it can present evidence during a January 30 hearing about a "stay" of the gaming license for the Hard Rock Hotel and Casino being built downtown.

That's the license the IRGC denied the Argosy Casino, in August.

Lawyers for Penn, which owns the Argosy, say the judge doesn't have jurisdiction to rule on the city's request.

They added that it would be an "affront to the judicial process" to allow the city into the case almost a-year-and-a-half after it started.
