Accused baby kidnapper appears in Iowa court

TIPTON (KWWL) - A woman charged with kidnapping a Wisconsin newborn and leaving him at a gas station in West Branch was in court Friday morning.

Kristen Smith had an extradition hearing on a Texas warrant, charging her with tampering with government records.

Police initially arrested Smith in West Branch because of the Texas warrant. Friday Smith signed extradition waivers, which means she will willingly go with Texas officials when they come to get her.

Smith did not speak to reporters outside the courthouse but her attorney did read a statement on Smith's behalf.

"She just wanted to express concern for her sister and also to just request and hope that everyone would respect her family's privacy as they are going through this ordeal," said Victoria Noel, Smith's Attorney. "Regardless of the ultimate facts or circumstances of what happened, she understands that her sister has gone through an ordeal and is just hoping that she's doing alright." 

Smith has her own children and asked the media respect their privacy. Her attorney did not know how many children Smith has or where they are now.

Smith still faces charges in Iowa for child endangerment and also faces a federal kidnapping charge.

When police first arrested her, she denied knowledge of Kayden Powell's whereabouts but then admitted to taking him after the baby was found alive 29 hours later.
