Iowa Supreme Court rules Penn vs. IRGC case ignore earlier appeal

DES MOINES, Iowa (KTIV) - Construction on the Hard Rock Casino continues as litigation on denial of the Argosy Casino's gaming license moves forward in Iowa District court.

Recently, a district court judge reconsidered a stay on the Hard Rock's license removing the stay completely.

Monday, the Iowa Supreme Court ruled that appeal is now concluded, and that the legal battle between Penn and the Iowa Racing and Gaming Commission should proceed as if the appeal had never happened.

Originally a district court judge placed a stay on the Hard Rock's license until litigation between Penn and the IRGC was concluded.

That was appealed to the Iowa Supreme court who stopped the stay and eventually sent it back to district court for which reconsidered and lifted the stay.
