While Penn National gaming and the Iowa Racing and Gaming Commission have spent this week battling in a Pennsylvania bankruptcy court, they are also working in the courts back home.
Late last week, Penn National gaming's subsidiary Belle of Sioux city filed a petition in Polk County District Court.
The petition argues that Belle and the Argosy Casino were given unfair treatment in hearings leading up to the denial of the Argosy's gaming license.
Court documents argue Belle was not allowed proper access to documents, and the IRGC had made its decision to deny the Argosy license long before the Hard Rock Hotel and Casino came into play.
The Belle is asking for a rehearing for consideration of the denial of their license or a release of the commission deliberations leading to the decision of it's denial, and ultimately the Argosy's closure.
Officials in Pennsylvania expect a decision on Belle's bankruptcy filing to come from a judge Wednesday.
