IRGC votes 5-0 to deny request for a stay of their April decision; Argosy still set to close July 1


The Belle of Sioux City has been denied in its latest appeal to the Iowa Racing and Gaming Commission to keep the Argosy Casino open beyond next Tuesday, the date by which it has been ordered to cease operations.

Both the Belle of Sioux City and the State of Iowa were given just a half an hour to present their case to the commission, and the IRGC went to executive session for just 24 minutes before announcing their decision.

Belle Attorney Mark Weinhardt went before the commissioners asking for a stay of the decision they made back in April, which will close the Argosy Casino on Tuesday.He said the 260 people losing their jobs at least deserved the chance to have a job while the matter is being addressed in Polk County Court.

He argued that the judge would need adequate time to make a decision affecting so many employees.

"Keep the boat open until August first, and allow her, in a reasonable, careful way, to make her decision that we're going to put in front of her tomorrow," Mark Weinhardt, the Belle of Sioux

However, John Lundquist from the Iowa Attorney General's office said the Belle could have easily brought this matter before the commission sometime in the last two months, at a time that wouldn't have caused for a special meeting to be scheduled.

Lundquist said the Belle waited until the very last minute to file this emergency motion.

"But to sit here and say that we're facing an emergency, that the judge doesn't have adequate time to rule, is simply a monster of their own creation," John Lundquist, Iowa Attorney General's Office said.

IRGC Chairman Jeff Lamberti said after the hearing that the IRGC made their decision because they felt it was necessary to be consistent in the decisions they've made about gaming in Woodbury County.
