Judge will decide fate of murder suspect in Madison County, NE


The second trial of a Norfolk man on second degree murder charges will not be heard by a jury.

The District Court Judge in Madison County approved 25-year old De'Aris Trice's request to waive his right to a jury trial, and hold a bench trial instead.

Trice submitted a letter to the court from Madison County Jail earlier this month.

Trice was found guilty of second degree murder for the stabbing death of Timothy Warren on Christmas night of 2010.

He was awarded a new trial last summer, after the Nebraska Supreme Court ruled that the jury received faulty instructions.
