Sapp's attorney wants interviews and text messages excluded from murder trial

The Attorney defending a northwest Iowa day care provider charged with murder is asking that interviews and text messages taken when she was detained in Minnehaha County, South Dakota be thrown out.

-three year-old Rochelle Sapp is charged with first-degree murder and child endangerment resulting in death.

Authorities say three-year old Autumn Elgersma died of blunt force trauma.

This, after they say, Sapp threw her to the floor when she refused to take her coat off.

The attorney for Sapp say she was taken into custody in Sioux Falls and never given Miranda Rights.

They say anything obtained in that time should be suppressed from the upcoming trial.

Sapp has pleaded not guilty to the first-degree murder charges.
